Yes No Questions, comments or other info you want us to know: Now & Zen Affiliate Program Agreement This agreement is made as of the date entered below between Now & Zen, Inc. and the Affiliate listed above. Subject to the provisions hereof, a free website account for the retail sale of Now & Zen products will be opened upon acceptance and execution of this contract. Affiliate agrees to use Now & Zen services and facilities at Affiliate 's own risk. Now & Zen specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall Now & Zen be liable for any loss, or loss of data, or any other damages. Affiliate agrees to protect and indemnify Now & Zen against any and all liability, loss, or expense arising from claims of libel, unfair competition, unfair trademarks, trade names or patents, violations of rights and privacy and infringement of copyrights and property resulting from Affiliate's use of Now & Zen Affiliate Program. Commission rate is 15% of retail price of product, net of returns (including Now & Zen's Money Back Guarantee offer). Shipping charges and tax are NOT commissionable. Commissions from sales generated thru the Free Now & Zen Affiliate Program web site will be paid to the Affiliate by check 30 days after the end of the month in which the sale(s) are shipped. Commissions are paid in amounts of $10 or more per month, amounts less than $10 per month will NOT be paid or carried over to another month. Affiliate is solely responsible for usage and any statement Affiliate makes on Now & Zen Affiliate Program system may be deemed a "publication" of the information entered. Acknowledging the foregoing, Affiliate specifically agrees not to use Now & Zen Affiliate Program service in any manner that is illegal, libelous, or against any Now & Zen Affiliate Program policy. This Agreement shall be governed by and interpreted in accordance with the laws of the State of Colorado, United States of America, and the courts of the judicial district of county of Boulder shall have exclusive jurisdiction in respect of any proceeding in connection with this Agreement.
